Topic: Selling someone else's design from Thingiverse

I have a few items on Thingiverse that I have put up as "Creative Commons - Attribution - Share Alike"
Every once in a while I check in on my dashboard to see activity of likes and downloads, etc.  Someone added my twisted floral vase to a collection called "Things to sell".  From my understanding that isn't allowed under the CCASA license.  Not like I'm going to prosecute them, just wondering if that is legal / ethical or what your thoughts are about it.

Unless you use the CC NC clause, and assuming that they include attribution, that could be a proper use.

If attributed and not "NC", selling is fair game.

they should at least contact designer "non-publicly" and ask for permission or if a commission would be acceptable besides posting name of designer with sale of item. but that would be too much like right these days it seems. I know a couple designers on Thingiverse that have worked with others selling their designs prints. most just want others to know their work and be noticed for it possibly for future consideration as in an artists portfolio for hire.

I know I would gladly give attribution and even a small % of profits to a couple Designers to promote their designs and likely would increase sales by doing so once people see their work.

Such politeness would be nice, but that is all.

However, the chosen license doesn't require it. If a CC NC variant were chosen, then the prospective seller would need to negotiate a resale license with the designer, if they intend to operate legally.

yep... il you didn't use the "NC" option of the CC licence, they can sell your product. they just need to give you attribution like a small print with the object  if they sell the printed object, or near the option to buy it if they sell the digital model...

as you use the 'share alike', they need to put any derivative or production , printed or digital with the same license as your original... aka "Creative Commons - Attribution - Share Alike

even with the NC designation, there will be those that just don't care and will use your design in any way they want to - one of the drawbacks of posting things on thingiverse.

Yeah the majority of my designs stay private, sometimes I get inspired by an idea or bored and throw together something quickly like that.  It's my most popular one, along with the optical illusion vase.  I wouldn't be that hurt if someone sold them, but if they put it up for sale somewhere like shapeways and made it part of their store that's not what I had in mind.  Guess I'll edit my things. 

Part of it is me giving back in the ways that I can to the community since I'm not innovating in the way that many of you are.  But something feels wrong about taking someone's work for free and selling it to someone else.

Interesting to read your thoughts on the subject.

well I have done lots of buying/selling/trading in my life and none of this current stuff with 3D printing has even come close to some of my troubles LOL.
one guy was a neighbor of mine and a coworker at a new job I moved there for and I put out the word at work I needed a dog house and my new job didnt pay much. this guy told me about a neighbor of ours that was moving and had a dog house for free, so I got another coworker to go with me in his pickup and get it. a year later dog was gone so I sold the Dog house for $20 to somebody. the guy that had told me about it a year earlier was very mad saying I should have split the $20 with him since he told me about it. LMAO can ya believe that? gee wiz there is just no pleasing some people. its not like I got rich off his invention. some people are jelous of anyone that makes any profit off anything they didnt when they could have. thats why I never tell anyone when asked how much I make in salary, sales, profits etc. only bad can result from it, no good. most things printed on 3D printers and sold will never make anyone rich or even self supporting income after paying utilities, materials, repairs, investment in tools, labor/time etc. it leaves very little profit to pay Royalties from or share.

Regardless of the license I might choose I try to think of anything I put on thingiverse as public domain.

also where do you see what type license a designer has on their models page? I dont see any on the ones I looked at but I am sure they have some type.

huh... the guy I was looking at has license listed on his thingiverse regular pages but he has started a couple months ago posting new models in his 'make' section with download link through thingiverse from an Amazon associated address site with no license listed on that make page. so how does that work??

you can simply ask him nicely to put your attribution on his amazon shop , as he was obliged to do it by the licence..

each time i do this for my own models, they do it without problem...

only one time, a user try to sell my models 2 times without attribution on 3dsha.re. i send them a DMCA takedown (yep.. it's easy a email...) and the model was removed... the second time, they closed the account..

something feels wrong about taking someone's work for free and selling it to someone else.

the optimist will say that glass is half full .
The pessimist will say the glass is half empty.
The engineer may say a smaller vessel is needed for full efficiency
the opportunist will grab the glass drink the beverage  and then may ask for more. 

It is a choice to respect or not respect others .
IMHO it is a symptom of the current buy cheap use and throw it away society. Few have an idea and appreciation for good design good craftsmanship and quality products. Grab it use it and toss it when not needed !!Who cares?

The engineer will say the glass is twice as big as it needs to be.  I like that version better.  LOL

oh how true Tin, its sad the way most people think nowadays. I very much apreciate fine quality craftsmanship from one that knows they are exposing their talent (or lack of) and stand behind it like any artist.

when I buy something I expect it to last until I no longer need it or my heirs get it. if that means buy antique then so beit.
